1. Definitions
The Club. Body Works West.
The Club Rules. The rules and regulations of the Club, as amended from time to time. A copy of the Club Rules is supplied with your application for membership and further copies are available on request.
Commitment Period. The minimum term you are committing to remain a member of the Club, from your start date to your commitment period end date (subject to extension if your membership is suspended).
2. Membership
By signing the Membership Application Form, the member agrees to comply with these Terms and Conditions of Membership and the Club Rules.
You will only be permitted to use the Club facilities provided your membership is current and fully paid up, or you have made payment arrangements acceptable to the Club.
3. Duration
When you join the Club you are agreeing to remain a member for the Commitment Period. If you pay monthly, your membership continues automatically after the Commitment Period at the fee rate applicable to your membership type at that date, subject to termination under clause 7.2(b). If you pay your Commitment Period fee in advance, your membership terminates automatically on expiry of the Commitment Period.
4. Fees
The Club sets the level of fees and reviews them periodically. The Club reserves the right to change fees from time to time, but guarantees fees will not increase during your Commitment Period. For any change to your monthly fee, we will give at least 30 days' written notice.
Membership fee. Determined according to the type and category of membership.
Joining fee. A joining fee may be payable as specified in your application form, covering start-up costs.
Guest user fee. Set by the Club from time to time in respect of guests of members who wish to visit and use the facilities.
Other fees. All other fees and prices for goods and services at the Club are set by the Club from time to time.
If your bank fails to make a due direct debit payment, we will write to advise you. We may apply to your bank for payment twice within one calendar month and reserve the right to refer any missed payment to a debt collection agency. We may charge a fee of no more than £15 for failed direct debit payments and no more than £5 for letters sent in respect of unpaid amounts.
Should membership fees remain unpaid 30 days after their due date, the full membership fee for the remainder of the commitment period becomes due and payable in full.
Any unpaid, overdue fees referred to a debt collection agency will be subject to a surcharge of no more than £30 to cover collection costs, together with all other charges and legal fees incurred, recoverable from the member.
We may charge a reasonable fee of up to £35 for replacing lost membership cards, adding or removing Associate members, changing membership category, or transferring memberships.
5. Member rewards
The Club may operate a referral scheme whereby you receive a benefit for introducing new members. If the member you introduce joins on an annual membership, you receive one month free; on a flexible/Direct Debit membership, two weeks free — subject to both memberships being current and not suspended. The benefit is fixed at the time the referred member joins, and the Club may set a limit on the number of members you can refer.
6. Suspension of membership
A member unable to use the Club due to illness or injury may suspend their membership for a continuous period of at least 1 month and a maximum of 2 months, with 30 days' written notice and, if requested, a doctor's certificate. A reduced monthly fee applies during suspension, and any suspension during the Commitment Period extends it by the length of the hold. Notice to terminate cannot run concurrently with a suspension period.
7. Termination
By the Club. We may terminate this agreement if you commit a serious or repeated breach not remedied within 7 days of a default notice; if any part of your membership fee remains unpaid 30 days after its due date; or if you provided false details that reasonably affected our decision to grant membership. In these cases we reserve the right to retain a proportion of monies paid to cover reasonable costs incurred.
By you. You may give notice at any point during the Commitment Period, though this cannot end membership before the Commitment Period ends. Outside the Commitment Period, at least 1 full calendar month's notice is required (membership ends at the end of the following calendar month). Cancelling your direct debit instruction alone is not sufficient notice.
You may also terminate on 1 calendar month's notice if serious illness or injury (evidenced by a doctor's certificate) will prevent you using the Club for at least 6 calendar months; if we permanently reduce facilities or opening hours; if we change the Club's location; if we close the Club for refurbishment for more than 30 days at a time; or if you joined less than 7 days ago and wish to use your cooling-off period.
8. Guests
Guests must present a valid guest pass and sign in at reception, keep to the Club's rules and regulations at all times, and are only entitled to use the facilities and activities booked on the day of their visit.
9. Club rules
The Club may amend the Club Rules from time to time to ensure members' health and safety. Temporary amendments are displayed in the Club; permanent changes are made only after at least 30 days' notice to members, except in an emergency.
The Club reserves the right to adjust the availability of certain facilities or close the Club temporarily for cleaning, decorating, essential repairs, equipment maintenance, special functions and holidays.
10. Restriction of liability
Subject to the paragraphs below, the Club does not accept liability for loss, damage to, or theft of money, valuables or other personal property of members and guests. Property stored in lockers is at the owner's risk.
Our liability to compensate you for loss or damage (other than death or personal injury) is limited to a reasonable amount, having regard to whether the damage was due to a negligent act or omission by us.
The Club accepts liability for damage, accident, death, personal injury or other loss sustained by members or guests on Club premises to the extent caused by its negligence or that of its employees and agents, unless attributable to your own fault, an unconnected third party, or events neither we nor our suppliers could reasonably have foreseen or forestalled.
11. Health & safety
Members must read all Health and Safety notices displayed in the Club and comply with their recommendations.
12. Sale of the club
If the Club is sold or disposed of to another company or person, we may transfer your membership to the new owner and you will continue as a member, provided no changes having a material adverse effect on your use of the Club are made by the new owner. Any such disposal will not affect your contractual or statutory rights.
13. Notices
Notices from you to the Club must be in writing, addressed to the General Manager. The Club may require evidence of posting or delivery where it has no record of receipt. Notices from the Club to you will be emailed to your address on our membership records, or displayed on notice boards at the Club where these terms permit.
14. Website use
By using this website you agree to use it lawfully and not to misuse any content, imagery or booking systems provided here. Class, personal training and tour bookings made through this website are subject to availability and our standard cancellation window.
